1. What these terms are
These terms are the agreement between you and Ohnyx IT Solutions Ltd for your use of mum's spaghetti — the family recipes web app at mumspaghetti.com (the "Service"). By creating an account or using the Service, you agree to these terms.
If you're a consumer in New Zealand, nothing in these terms limits or excludes your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. Where these terms say something less generous than those laws, the law wins.
If you're a consumer in Australia, our services come with guarantees under the Australian Consumer Law that cannot be excluded, and nothing in these terms limits or excludes them. If you live in the United States or anywhere else, you may have consumer rights under your local law too; where your local law gives you rights that can't be waived by contract, these terms don't take them away.
2. What the Service is
mum's spaghetti is a place for families to keep, share, and cook from their recipes. You can:
- Upload photos of recipes (handwritten cards, cookbook pages, printouts) and have them read and converted into structured recipes by artificial intelligence;
- Organise recipes in a family group, invite family members, and share or copy ("fork") recipes;
- Get AI-generated suggestions: ingredient substitutions, variations, scaling, and a recipe chat assistant;
- Build meal plans and shopping lists, and see estimated nutrition information.
The Service is currently offered to customers in New Zealand, Australia, and the United States, and subscription purchases may be limited to those countries. Prices at checkout are shown in your local currency (NZD, AUD, or USD).
3. Beta status
The Service is in an early period of its life (a beta). That means:
- We control how and when registration opens: access may be by invitation, limited to a capped number of sign-ups, opened more widely, or paused — and we may change the way in at any time. Changing who can join never changes the terms for people already in.
- Features may change, be added, or be removed as we develop the Service. We'll give you reasonable notice (normally by email) before removing a feature you rely on or making a change that significantly affects you.
- We do not reset or delete your recipe data as part of beta development. If we ever needed to, we would tell you first and give you the chance to export or save your content.
- Beta doesn't mean "no rights" — your rights under consumer law (section 1) apply to the Service as it is offered, including any paid plans, during beta.
4. Accounts and families
The words we use. The Service is organised around family groups, so let's be precise about who's who:
- A family (or family group) is a private group of accounts that share recipes and one subscription. Despite the name, it's just a group in the app — its members don't need to be legally related, live together, or be an actual family, and being in a family group never creates any legal relationship, partnership, or agency between its members.
- The family owner is the single account that administers the group: invitations, member removal, and billing. The app affectionately calls this person "Mum", whoever they actually are — nothing about the role depends on gender or family position. The owner is the billing party: the subscription is their purchase alone, and the billing obligations in section 6 sit with them.
- A family member is any other account in the group, joined by the owner's invitation. Members get the benefit of the family's subscription (the shared extraction allowance, shared recipes) but are not liable for any of its charges. Every member is an individual account holder who agrees to these terms for themselves.
- The owner controls membership, not members' recipes: each person's recipes remain their own (section 9). What happens when a member leaves or is removed is in section 10.
- A fork is a copy of a recipe made into another user's own library (section 9).
Who can sign up. You must be at least 16 years old to create your own account. Younger family members may use the Service only through an account created with the knowledge and consent of their parent or guardian; the family owner is responsible for making sure that's the case for anyone they invite. The family owner (the billing account holder) must be at least 18.
Accurate details. Give us a real name and a working email address — we use email for security messages, invitations, and billing notices.
One account per person. Don't create accounts to game free credits or evade a suspension.
5. Account security and two-factor authentication
- You're responsible for keeping your password secret and for activity that happens under your login. Tell us promptly at [email protected] if you think your account has been compromised.
- The Service supports (and may require) two-factor authentication (2FA) using an authenticator app. If you enable 2FA, keep your recovery codes somewhere safe — they are the way back in if you lose your device. A self-service 2FA reset flow exists, but it has deliberate safeguards and delays; we can't always restore access instantly.
- Don't share your login with people outside your household. Invite them to the family instead — that's what it's for.
6. Subscriptions, credits, and billing
Payments are processed by Stripe. We never see or store your card number.
6.1 The free taster
Every new family gets a small number of free AI recipe extractions (currently 5) to try the Service. These are a one-off, lifetime allowance for the family — they don't renew monthly, and once used the family needs a subscription to keep extracting recipes. Non-AI features you've already used (viewing and editing your existing recipes, meal plans, shopping lists) keep working.
6.2 The family subscription
- One plan, billed to the family owner, covering the whole family group.
- Billing is monthly (an annual option may be offered later; if it is, these same terms apply to it). The current price is always shown on the billing page and at checkout, in your local currency. For New Zealand customers, prices include GST; for customers elsewhere, any applicable taxes are calculated and shown at checkout.
- Your subscription renews automatically at the end of each billing period, and Stripe charges your saved payment method, until you cancel.
- A subscription includes a monthly allowance of AI recipe extractions (currently 50 per billing period, shared across the whole family). This allowance resets at each renewal and unused extractions do not carry over — it's a usage allowance, not a stored credit.
- Other AI features (chat, substitutions, variations) are included without per-use metering, subject to fair-use rate limits (section 8).
6.3 Boost packs
- If your family uses up the monthly allowance, you can buy a one-off boost pack of extra extraction credits (currently 20 credits per pack).
- Boost credits are different from the monthly allowance: they do not expire and carry over between billing periods until used.
- Extractions always use your monthly allowance first, then boost credits — so light months never eat into credits you've paid extra for.
- Boost packs are one-off purchases, not subscriptions. They're only usable with an active subscription, since they top up a subscriber allowance.
6.4 Cancelling
- You can cancel your subscription at any time from the billing page (which opens the Stripe billing portal). No phone calls, no hoops.
- When you cancel, your subscription runs to the end of the period you've already paid for, and doesn't renew. Your recipes and data remain in your account; AI extraction stops when the paid period ends (any remaining boost credits are preserved and usable again if you resubscribe).
6.5 Refunds
- If something we're responsible for goes wrong — the Service fails to do what the Consumer Guarantees Act says it should — you're entitled to the remedies that Act provides, which can include a refund. We don't exclude or limit that.
- Beyond your statutory rights: we don't generally refund partly-used billing periods or used credits, but if you think you've been charged in error, or you've had a genuinely bad run (for example, extractions that failed outright and still consumed credits), email us at [email protected] — we're a small operation and we'd rather fix it than argue.
- Failed extractions caused by a fault on our side shouldn't consume credits; if one does, tell us and we'll restore the credit.
6.6 Price changes
- We may change subscription and boost prices. If we do, we'll email the family owner at least 30 days before the new price takes effect.
- A price change never applies to a period you've already paid for. If you don't want to pay the new price, cancel before your next renewal and you won't be charged it.
6.7 GST, taxes, and receipts
Prices shown to New Zealand customers include GST. For customers in Australia, the United States, or elsewhere, any applicable taxes are calculated and shown at checkout. Stripe emails receipts/invoices to the family owner's email address.
7. AI features — please read this one
The recipe extraction, chat, substitutions, variations, scaling help, and nutrition estimates are generated by artificial intelligence (we use a leading commercial AI provider). AI is genuinely useful and genuinely fallible. So:
- Always check extracted recipes against the original. The AI can misread handwriting, skip a line, get a quantity or unit wrong, or mislabel an ingredient. You can edit every extracted recipe — please review it before you cook from it.
- Allergies and intolerances: do not rely on the AI. Extracted ingredient lists, substitution suggestions, and nutrition estimates may omit or misidentify allergens. If anyone eating the food has an allergy or intolerance, verify ingredients yourself from the original source and product labels.
- Food safety is your call. Cooking times, temperatures, and food-handling steps in extracted or AI-suggested content may be wrong or incomplete. Use your own judgement (and a meat thermometer) — especially for meat, poultry, seafood, eggs, and preserving/canning.
- Nutrition figures are rough estimates, generated automatically for general interest. They are not a substitute for professional dietary, medical, or nutritional advice and shouldn't be used to manage a medical condition.
- AI chat is a kitchen helper, not a professional. Its suggestions are not medical, dietary, or safety advice.
We design the Service to make review easy (extracted recipes are editable drafts, originals stay attached), but the final check is yours. To the extent New Zealand consumer law allows, we are not liable for loss caused by relying on AI-generated content without checking it — though nothing in this section limits the guarantees that law gives you.
8. Acceptable use
Keep it kitchen-table friendly. You agree not to:
- Upload content that is illegal, infringes someone else's copyright, or is abusive, hateful, or explicit;
- Upload substantial portions of copyrighted cookbooks or paywalled recipe content you don't have the right to copy (a family's handed-down recipes and your own notes are exactly what the Service is for; wholesale digitising someone else's book is not);
- Attempt to breach, probe, or overload the Service, other users' accounts, or our infrastructure;
- Use bots or scripts to bulk-extract, scrape, or hammer the AI features. AI endpoints have per-user and per-family daily rate limits, and we may enforce them technically;
- Resell the Service or use it to provide a service to others;
- Misuse invitations or family codes to access a family you weren't invited to.
If you break these rules we may warn you, suspend AI features, or (for serious or repeated breaches) suspend or close your account under section 12.
Copyright complaints. If you believe content in the Service infringes your copyright, email [email protected] with enough detail to identify the content and your rights. We review complaints promptly, remove content we reasonably believe infringes, and may suspend repeat infringers.
9. Your content — ownership and licence
Your recipes are yours. You (or your family's cooks before you) own your recipes, photos, notes, and everything else you upload or create in the Service. We claim no ownership.
The licence you give us. So that the Service can actually work, you grant Ohnyx a non-exclusive, worldwide, royalty-free licence to host, store, back up, reproduce, process, adapt (for example, converting a photo into structured recipe text), and display your content — only as needed to operate, secure, and improve the Service and its features. This includes:
- Sending your recipe photos and text to our AI provider to perform extraction, chat, and suggestions you request;
- Showing your recipes to the members of your family group;
- Showing recipes to other users where you or your family share them through the Service's sharing features;
- Keeping encrypted backups.
This licence ends when your content is deleted from the Service, except that (a) copies may persist in encrypted backups for the backup retention period described in the Privacy Policy, and (b) forked copies survive as described below. We do not use your content for advertising and we do not sell it.
Sharing and forking. When a recipe is shared with another family, or another user forks it, the fork is a copy that belongs to the forker's library. That's by design — it's how Nana's recipe survives in your cousin's kitchen. If you later delete a recipe or your account, forks that others made remain theirs (your name may remain attached as attribution). Don't share a recipe you're not happy for others to keep.
10. Leaving a family, removal, and account deletion
- If you're removed from your family (or your family dissolves), your account isn't deleted immediately. You get a 90-day window in which you can either (a) upgrade to your own family plan ("elevation" — you pay, create your own family, and keep your recipes), or (b) do nothing, in which case after 90 days your account and all your data (recipes, photos, meal plans, favourites) are permanently deleted. We email you about this window when it starts, including a sign-in link.
- You can delete your own account at any time from your profile page (you'll confirm with your password). Deletion is permanent, subject to the backup retention window in the Privacy Policy.
- Family owners: deleting your account or cancelling doesn't automatically delete your family members' accounts, but a family without an owner can't be billed, so members may end up in the 90-day window above. If you want to hand the family to someone else instead, contact us.
- Inactive free accounts: if your family has never had a subscription and nobody in it signs in for 90 days, we may delete the family, its accounts, and all its content. We'll email the family owner at least 14 days beforehand, and one sign-in by any member keeps everything. Families that have ever subscribed are never deleted for inactivity.
- Deleting content or an account does not delete forks other users have already made (section 9).
11. Availability and support
mum's spaghetti is a small, independently hosted service — not a global cloud platform with a five-nines guarantee — and it's priced accordingly. So, honestly:
- We aim to keep the Service up and healthy, we run monitoring and nightly encrypted backups, and we fix problems as fast as a small team reasonably can.
- We do not promise uninterrupted or error-free availability, and we may take the Service down briefly for maintenance (we'll try to pick quiet hours and give notice for anything long).
- Support is by email at [email protected], best-effort, on New Zealand time.
Nothing in this section overrides the Consumer Guarantees Act's guarantee that services will be provided with reasonable care and skill — that always applies.
12. Suspension and termination by us
We may suspend or close your account if you materially breach these terms (including non-payment or acceptable-use breaches), if we're required to by law, or if we discontinue the Service.
- For breaches, we'll normally warn you and give you a chance to put it right first, unless the breach is severe (e.g. unlawful content or attacks on the Service).
- If we discontinue the Service entirely, we'll give at least 30 days' notice, provide a way to export or retrieve your recipes, and refund any prepaid amounts for periods after the shutdown date.
13. Our liability
- New Zealand consumers: nothing in these terms excludes, restricts, or modifies your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. If those laws give you a remedy, you have it, full stop.
- If you use the Service for business purposes (unusual, for a family recipes app, but possible), you agree the Consumer Guarantees Act does not apply to that use, as section 43 of that Act allows.
- To the extent permitted by law, and except for the consumer rights above: we're not liable for indirect or consequential loss, and our total liability to you for anything arising out of the Service is capped at the amount you paid us in the 12 months before the event giving rise to the claim.
- Australian consumers: our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts, or modifies those guarantees or your rights to remedies for their breach.
- Wherever you live: the exclusions and limits above apply only to the maximum extent your local law allows. Some jurisdictions don't allow certain warranties to be excluded or certain liabilities to be limited — if that's where you live, those exclusions and limits apply to you only as far as your law permits.
- Nothing in these terms limits liability that cannot lawfully be limited.
14. Changes to these terms
- We may update these terms from time to time. Every version has a version number and effective date, and we keep a version history (below) so it's always clear which text you agreed to and when.
- For material changes, we'll email account holders at least 14 days before the new version takes effect (30 days for price changes, per section 6.6). Continuing to use the Service after the effective date means you accept the new version; if you don't accept it, you can cancel and stop using the Service before it takes effect.
- Trivial fixes (typos, contact details) may take effect immediately but still get a version entry.
15. General
- Governing law: these terms are governed by New Zealand law, and the New Zealand courts (including, where applicable, the Disputes Tribunal) have jurisdiction. If you live outside New Zealand and your local law gives you mandatory consumer protections, or the right to bring a dispute in your local courts or tribunals, nothing in this clause takes that away.
- Privacy: our Privacy Policy explains what personal information we collect and how we handle it. It forms part of your agreement with us.
- Assignment: we may transfer this agreement as part of a restructure or sale of the Service; your rights under it won't be reduced by the transfer. You may not transfer your account to someone else without our agreement.
- Severability: if part of these terms is found unenforceable, the rest still stands.
- Entire agreement: these terms plus the Privacy Policy are the whole agreement between us about the Service.
